Commercial Filming and/or Still Photography
Insurance Requirements
Requesting party shall not commence filming/photography until it has obtained all required insurance and certification of such insurance has been approved by CSU.
Policies and Coverage
- Required.
Requesting party shall obtain and maintain the following policies and coverage:- Comprehensive or Commercial General Liability Insurance, on an occurrence basis, covering work outlined in the location agreement and providing insurance for bodily injury, personal injury, property damage, and contractual liability.
- Business Automobile Liability Insurance on an occurrence basis, covering owned, hired, and non-owned automobiles used by or on behalf of requesting party and providing insurance for bodily injury, property damage, and contractual liability. Such insurance shall include coverage for uninsured and underinsured motorists.
- Worker's Compensation, including Employers Liability Insurance as required by law.
- Requesting party may also be required to obtain and maintain other insurance as agreed upon by CSU and requesting party.
- Verification of Coverage.
Requesting party shall submit original certificates of insurance and endorsements to the policies of insurance required by the location agreement to CSU as evidence of the insurance coverage. Renewal certifications and endorsements shall be timely filed by requesting party or their contractor for all coverage until the work covered in the location agreement is accepted and has been completed. CSU reserves the right to require requesting party to furnish CSU with complete, certified copies of all required insurance policies.- Required Provisions.
Nothing in these insurance provisions shall be deemed to alter the indemnification provisions in this Contract. The insurance policies shall contain, or be endorsed to contain, the following provisions.- The general and automobile liability policies shall name the State of California, CSU, the Trustees of the California State University, and their officers, employees, representatives, volunteers, and agents as additional insureds. Such endorsement shall be documents on an ACCORD or similar form for this purpose; a statement on the certificate itself does not satisfy this requirement.
- For any claims related to the location agreement work, requesting party’s insurance coverage shall be primary insurance as respects the State of California, CSU, the Trustees of the California State University, and their officers, employees, representatives, volunteers, and agents. Any insurance or self-insurance maintained by the State of California, CSU, the 2 Trustees of the California State University, and their officers, employees, representatives, volunteers, and agents shall be in excess of the requesting party’s insurance and shall not contribute with it.
- Each insurance policy required by this section shall state that coverage shall not be canceled by either requesting party or the insurance carrier, except after thirty (30) days prior written notice by certified mail, return receipt requested (or other written notice with proof of receipt), has been given to CSU.
- The State of California, CSU, the Trustees of the California State University, and their officers, employees, representatives, volunteers, and agents shall not by reason of their inclusion as additional insureds incur liability to the insurance carriers for payment of premiums for such insurance.
- Each insurance policy required by this section shall contain an endorsement providing a waiver of transfer of rights of recovery against others (waiver of subrogation) as to the State of California, CSU, the Trustees of the California State University, and their officers, employees, representatives, volunteers, and agents.
- Amount of Insurance
- Minimum Coverage.
The limits stated below are minimum required amounts of insurance coverage but do not serve to limit amounts recoverable by CSU. CSU is entitled to any valid and collectible insurance and any other sources of recovery. The insurance furnished by the requesting party under the location agreement shall provide coverage in amounts not less than the following:- Comprehensive or Commercial General Liability Insurance—Limits of Liability
- $4,000,000 General Aggregate
- $2,000,000 Each Occurrence—combined single limit for bodily injury and property damage.
- $2,000,000 Each Person/Entity for personal liability
- $2,000,000 for contractual liability
- Business Automobile Liability Insurance—Limits of Liability: Business Automobile Liability Insurance on an occurrence basis, covering owned, hired and non-owned automobiles used by or on behalf of requesting party and providing insurance for bodily injury, property 3 damage, and contractual liability. Such insurance shall include coverage for uninsured and underinsured motorists.
- Owned Autos: Only if the filming company owns the vehicles they will be driving on to campus.
- Hired and Non-Owned Autos: This would include rental vehicles and/or personal vehicles. For personal vehicles this would apply on an excess basis, as primary insurance follows the vehicle.
- $1,000,000 Each Accident—combined single limit for bodily injury and property damage to include uninsured and underinsured motorist coverage.
- Workers’ Compensation—limits as required by law with Employers Liability limits of $1,000,000. Acceptability of Insurers Insurers shall be licensed by the State of California to transact insurance and shall hold a current A.M. Best’s rating of A:VII, or shall be a carrier otherwise acceptable to CSU.

Acceptability of Insurers
Insurers shall be licensed by the State of California to transact insurance and shall hold a current A.M. Best’s rating of A:VII, or shall be a carrier otherwise acceptable to CSU.
